Judge Rules Noncitizen Voting Law Unconstitutional

A federal judge has dismissed a case against a Jamaican national accused of illegal voting. The court found that the 1996 law criminalizing noncitizen voting violates the US Constitution by encroaching on state powers.

A United States federal judge dismissed a case against a Jamaica national on Thursday, ruling that the 1996 law criminalizing noncitizen voting is unconstitutional. The decision deals a blow to the Trump administration's broader enforcement push against alleged election fraud. The ruling by Miami-based District Judge David Leibowitz applies exclusively to Florida resident Chelsea Cox, who was charged in October 2025 with casting an illegal ballot in the 2020 presidential election.
