The judge further characterized the class-action waiver in the 2019 terms as ambiguous and unenforceable. The legal action also names Binance founder and former chief executive Changpeng Zhao as a defendant. While many companies prefer arbitration because it is confidential and often less expensive than public litigation, the plaintiffs in this matter are seeking to recover losses linked to seven specific tokens: ELF, EOS, FUN, ICX, OMG, QSP, and TRX. The customers allege that Binance failed to provide necessary warnings about the risks of these purchases, as mandated by federal and state securities regulations. This legal battle has seen multiple stages, with Judge Carter initially dismissing the lawsuit in 2022. However, a federal appeals court revived the case two years later, leading to the recent decision regarding the venue of the dispute.
