Judge Rejects Bayer Bid to Block J&J Prostate Drug Ads
A U.S. judge rejected Bayer's bid to block Johnson & Johnson advertising for its prostate cancer drug. The court found no proof the claims were misleading.
A federal judge in the United States has denied a request from BAYER AG-REG to halt an advertising campaign by JOHNSON & JOHNSON regarding its prostate cancer medication, Erleada. The legal challenge centered on claims that the drug significantly reduces the risk of death compared to competing treatments.
U.S. District Judge Dale Ho, presiding in Manhattan, ruled that the German pharmaceutical giant failed to demonstrate a high probability of success on the merits of its case. Bayer had argued that the marketing efforts for Erleada caused irreparable damage to its own drug, Nubeqa, and potentially undermined professional trust in the product.
