EU Court Upholds Ruling Against Lufthansa Bailout

The European Union's highest court has confirmed the annulment of the European Commission's decision to approve a massive state aid package for Lufthansa. The ruling, delivered on Thursday, solidifies a previous legal victory for competitors who challenged the multi-billion euro bailout granted during the height of the COVID-19 pandemic in 2020.

The Court of Justice of the European Union upheld a 2023 lower court decision that struck down the approval of the 6 billion euro rescue plan provided by Germany. The legal challenge was originally spearheaded by RYANAIR HOLDINGS PLC, the low-cost carrier based in Ireland, which has consistently argued that pandemic-era state subsidies for national flag carriers distorted fair competition within the European aviation market.
This final judgment marks a significant setback for the European Commission's oversight of state aid, as the court found that the executive body had failed to ensure the bailout did not unfairly disadvantage other airlines. While Lufthansa has already repaid the majority of the funds, the ruling raises questions regarding the procedural standards required for future emergency financial interventions by member states.
