The United States federal consumer finance watchdog has formally terminated specific civil-rights-era anti-discrimination requirements for the lending industry. According to a notice in the federal register released on Tuesday, the Consumer Financial Protection Bureau (CFPB) finalized the change, fulfilling a directive from President Donald Trump to reduce long-standing policies described as a burden on businesses. Under the new regulatory framework, lenders are no longer required by the 1974 Equal Credit Opportunity Act to prevent policies and practices that produce unintentionally discriminatory results for borrowers, a concept known as disparate impact. While the prohibition against explicit and intentional discrimination remains in effect, the removal of disparate-impact liability eliminates a tool that the government has utilized for decades to address racial and gender discrimination in housing, education, and lending. The White House has previously argued that the disparate impact doctrine undermines equal opportunity and prevents businesses from making employment and hiring decisions based strictly on merit and skill. However, consumer rights organizations have denounced the move, suggesting that ceasing to enforce these requirements will make preventing discrimination in major economic sectors significantly more difficult. These groups have indicated the possibility of legal challenges, noting that the doctrine is rooted in Supreme Court precedent.
