Abbott Laboratories must defend against a proposed class-action lawsuit after a federal judge ruled that marketing for its PediaSure Grow & Gain drinks could mislead consumers about height growth. U.S. District Judge Paul Engelmayer ruled on Thursday that visual cues on labels and in commercials could support a consumer belief that the product is clinically proven to make children taller. The decision allows claims of deceptive marketing to proceed to trial for the Abbott Park, Illinois-based company.
