A federal judge in Boston ruled that the 100,000 dollar fee imposed on new H-1B visas constitutes an unauthorized tax rather than a lawful penalty. The decision follows a lawsuit from 20 states arguing the administration lacked the congressional authority to implement such significant costs for skilled worker permits.
U.S. District Judge Leo Sorokin struck down a $100,000 H-1B visa fee on Monday, ruling the charge was an unauthorized tax. The decision reverses a September policy that increased the cost of skilled-worker visas from a previous range of $2,000 to $5,000. The ruling eliminates a financial barrier for tech companies that rely on foreign talent to fill high-skilled roles.
