The United States Food and Drug Administration (FDA) will ease enforcement against unauthorized e-cigarettes and nicotine pouches that have pending marketing applications. This shift applies to products with applications accepted for review or supplemental filings pending for more than 180 days. The move provides regulatory relief for tobacco manufacturers navigating a multi-year backlog of federal authorizations.
### FDA Shifts Focus to High-Risk Products The FDA stated on Friday it will deprioritize enforcement against companies that have submitted comprehensive scientific data for review. This policy change allows manufacturers to continue selling certain products without a final license, provided they meet specific agency criteria. The agency noted it lacks the resources to pursue every unauthorized product currently on the market.
