The shipping giant FedEx Corporation is facing a federal class-action lawsuit from customers demanding refunds for tariffs following a landmark United States Supreme Court ruling. The judicial decision, handed down earlier this month, determined that billions of dollars in emergency tariffs imposed by the executive branch were unlawful. The proposed class action, filed in a Miami federal court, seeks compensation for potentially millions of shippers who paid import duties and related fees on goods they argue should have entered the country duty-free. While the company has indicated it will pass along any refunds it receives from the government, the lawsuit contends that this promise is not legally binding. > "If refunds are issued to FedEx, we will issue refunds to the shippers and consumers who originally bore those charges." Legal representatives for the plaintiffs argue that the company must be held accountable for the immediate return of these funds. John Yanchunis, an attorney for the lead plaintiff, emphasized the objective of the litigation. > "Our goal is to return to American consumers every penny they were improperly charged." The lead plaintiff, Matthew Reiser, detailed a specific instance where he was charged $36 for tennis shoes purchased from a retailer in Germany. This total included $21 in duties under the International Emergency Economic Powers Act (IEEPA) and $15 in clearance fees, which the lawsuit maintains were unnecessary. The Supreme Court's 6-3 decision on February 20 found that the use of IEEPA to implement broad tariffs exceeded presidential authority. This ruling has triggered a massive wave of litigation, with over 2,000 companies already suing the federal government in the Court of International Trade. On Friday, Hasbro, Inc. joined the thousands of companies seeking recovery of paid tariffs. Other international firms involved in similar legal actions include the beauty group L'Oreal, based in France, and the vacuum manufacturer Dyson from the United Kingdom. These companies are joined by other prominent retailers such as Costco, J. Crew, and contact lens maker Bausch + Lomb, all seeking to recover funds paid under the contested tariff policies.
