Brazil Rejects State-Run Mineral Firm Proposal

Industry Minister Marcio Elias Rosa dismissed the need for a state-backed mining entity today. He also labeled a minerals deal with the U.S. unconstitutional.

The government of Brazil has officially rejected proposals to establish a state-run enterprise dedicated to critical minerals, signaling a preference for existing regulatory frameworks over new state-backed entities. Industry Minister Marcio Elias Rosa addressed recent legislative suggestions to create a company dubbed Terrabras, asserting that the current legal landscape provides sufficient incentives for the exploration and processing of strategic resources.

There is no need whatsoever to create a state-owned company to carry out the exploration or processing of critical minerals.

In addition to dismissing the need for a national minerals firm, the federal government has raised significant legal concerns regarding a cooperation agreement signed between the state of Goias and the United States. The deal, which aimed to map mineral potential and integrate local mining operations with American technology and regulatory standards, has been characterized by federal officials as a breach of national protocol.

Minister Rosa argued that the agreement oversteps the constitutional authority of individual states, noting that the power to regulate mineral resources and conduct international diplomacy is reserved exclusively for the federal administration.

From a constitutional and legal standpoint, it does not hold up.

By challenging the Goias-U.S. partnership, the federal government is reasserting its centralized control over the critical minerals sector, which is increasingly viewed as a cornerstone of global energy transition and industrial strategy. The administration maintains that the existing regulatory framework is the most effective path forward for attracting investment and managing the nation's vast mineral wealth.
